Platform rules, customer responsibilities, and billing clarity
These Terms of Service govern access to and use of the Forismo platform, including messaging, calling, AI-assisted workflows, workspace tools, and related products or services operated under the Forismo brand.
1. Acceptance of these terms
By accessing or using Forismo, you agree to these Terms of Service and to our Privacy Policy. If you use Forismo on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Accounts and platform access
You are responsible for maintaining accurate account information, protecting access credentials, and ensuring that activity under your account complies with these terms and applicable law.
- You must provide accurate registration and billing information.
- You are responsible for all activity that occurs through your account or workspace.
- You must notify us promptly if you suspect unauthorized access or misuse.
3. Acceptable use
You may not use Forismo to:
- send unlawful, abusive, deceptive, infringing, or spam communications
- harvest data, scrape users, or bypass workspace or conversation permissions
- upload malicious code, interfere with the service, or attempt unauthorized access
- use telecom or messaging features without the required permissions, disclosures, or recipient consent
4. Messaging, calling, and telecom features
Some Forismo features depend on third-party telecom or delivery providers. Availability may vary by region, carrier, number type, or regulatory rules. You are responsible for using these features in compliance with applicable messaging, telemarketing, anti-spam, privacy, and consumer protection laws.
- Delivery is not guaranteed for SMS, voice, or email channels.
- Carrier filtering, number registration rules, and regional restrictions may apply.
- Additional telecom, carrier, usage, or number fees may apply where relevant.
5. Customer content, AI features, and cross-border processing
You retain your rights to the content you submit to Forismo. You grant us the limited rights needed to host, secure, process, transmit, and display that content to operate the service. Certain AI-powered features may require additional consent or may depend on third-party AI providers.
- You are responsible for obtaining any permissions needed before uploading third-party data.
- You must not use the service to process data that you do not have the legal right to use.
- Privacy, retention, and data-handling practices are described in our Privacy Policy.
5.1 Optional AI features and express choice
AI-powered features in Forismo are optional. If you or your workspace choose to activate AI-assisted summaries, search, drafting, classification, transcription, or similar features, you are expressly directing Forismo to process the relevant content for those purposes. If you do not enable those features, the core platform can still be used without that optional AI processing path.
5.2 Canadian privacy disclosure and PIPEDA transparency
For users in Canada, enabling optional AI features may involve processing by service providers located outside Canada, including the United States or other jurisdictions where those providers operate. Depending on the feature, this may include message content, attachments, transcripts, prompts, summaries, and related metadata that are reasonably necessary to deliver the feature.
- When you activate optional AI features, you acknowledge that the processing may occur outside Canada.
- While information is being processed in another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to foreign courts, law enforcement, or national security authorities.
- Forismo remains responsible for personal information under its control and uses contractual, technical, and organizational safeguards intended to provide a comparable level of protection.
- You may choose not to enable optional AI features, and where available you may later withdraw or change that choice, though the affected AI features may then stop working or become limited.
These disclosures are intended to support meaningful consent and transparent handling of personal information in line with Canadian privacy expectations, including PIPEDA.
6. Billing, cancellation, and refunds
Paid plans, add-ons, telecom services, and usage-based features may require advance payment, recurring payment authorization, or both. Where applicable, checkout, tax handling, and payment processing may be provided by Paddle or another authorized payment provider.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- Subscriptions renew automatically until cancelled.
- You may cancel at any time to stop future renewals.
- Unless required by law, cancellations take effect at the end of the current paid billing period.
- Forismo offers a 30-day money-back guarantee from the order completion date.
- If you request a refund within 30 days of the order completion date, the order is eligible for a refund.
- After 30 days from the order completion date, charges are non-refundable.
7. Suspension and termination
We may suspend or terminate access to the service if reasonably necessary to address abuse, non-payment, fraud, legal exposure, security concerns, or violations of these terms. You may stop using the service at any time.
8. Service changes and availability
We may update, improve, limit, or discontinue features from time to time. We aim to provide a reliable service, but uninterrupted availability is not guaranteed.
9. Intellectual property
The Forismo platform, software, interface design, branding, and related materials remain the property of Forismo or its licensors. These terms do not transfer ownership of our software, trademarks, or service materials to you.
10. Disclaimer and liability limits
To the fullest extent permitted by law, Forismo is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, error-free operation, or fitness for every specific use case.
To the fullest extent permitted by law, Forismo will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, or data arising from your use of the service.
11. Changes to these terms
We may revise these terms from time to time. If we make material changes, we may post the updated version on this page and, where appropriate, provide notice through the product or by email. Continued use of the service after an update takes effect constitutes acceptance of the revised terms.
